2. The application, which was duly made through Her Majesty's Consul at Canton, was handed in to the Acting Colonial Secretary by a Chinese Officer of the rank of recorded Ensign, or, as he was generally known, of Sergeant Major.
The Prisoner So-a-Pin was already in custody at the instance of this Sergeant Major, Chun, and the Police Authorities were instructed to have the case brought before the Sitting Magistrate in the usual course.
3. During the investigation, evidence conclusively proving that the Prisoner So-a-Pin was not connected with the offence charged against him was produced, and at the same time statements were made implicating the Chinese Officer and his witnesses in a fraudulent attempt to prove a prima facie case against the Prisoner.
The Prisoner was discharged, and it was then that his Attorney entered a charge against the Chinese Officer and his witnesses of conspiracy to pervert the course of justice.
